Terms and Conditions

This agreement is established between you as the user of our platform services, both on the website and application, with AION Automobile Sales (Thailand) Co., Ltd. (hereinafter referred to as "we" or "AION") which operates and is responsible for the website platform (https://www.aionauto.com/th-th) and AION application, excluding the e-wallet and electric vehicle charging sections.

 

GAC Energy Technology (Thailand) Co., Ltd. operates and is responsible for the AION application platform specifically for the e-wallet and electric vehicle charging sections (hereinafter referred to as "GAC Energy"). We have separate terms and conditions for electric vehicle charging, which you can read more about at this link.

 

  1. 1. Company Information and Services

 

The AION platform aims to provide comprehensive vehicle-related information and services, including:

- User account creation

- Test drive booking

- Vehicle status monitoring

- Online vehicle control

- Service center appointment booking

- Electric vehicle charging

- Service center location identification

 

Using our platform implies immediate acceptance of these service terms, and you agree to comply with the stated conditions. If you disagree with these terms, please discontinue using the platform.

 

  1. 2. Additional Terms You Should Know

 

You can access our privacy policy and cookie policy through the provided links, which explain how we handle your personal information. If there are new requirements or additional guidelines related to our services, you agree to strictly comply with them.

 

  1. 3. Modification of Terms of Use

 

We reserve the right to modify service agreements or related rules at any time. Such changes take effect immediately upon announcement on our website. Reasons for updates may include:

- Making agreements easier to understand and fairer

- Updating to comply with relevant laws or regulations

- Developing guidelines according to industry or technological standards

Please check this page frequently for updates. Continued use of services after changes implies acceptance of new terms.

 

  1. 4. Platform Updates and Access

 

We reserve the right to update and modify our platform, including service modifications, functionality, or content without prior notice. Platform information may not always be current, and we have no obligation to keep information consistently updated. Additionally, we cannot guarantee that the platform will be error-free or without omissions.

 

  1. 5. Platform Access and Usage

 

The AION platform is provided free of charge. However, we do not guarantee uninterrupted platform or service availability. We may suspend or terminate all or part of the services at any time without prior notice, and we are not liable for any service access or usage interruptions.

 

You must be at least 20 years old or have legal capacity to enter into contracts to access the platform. You are also responsible for all necessary preparations to access the platform and must ensure that anyone accessing the platform through your connection strictly complies with this agreement.

 

  1. 6. Account Information and Security

 

Account registration is necessary to access certain platform services. You must keep login information confidential and implement security measures. If you wish to change your username or password, you may do so under our terms but will remain responsible for any activities occurring before the change.

 

To protect your information, follow these recommendations:

- Lock devices when not in use

- Protect against viruses, malware, and spyware

- Log out after each session

- Avoid using unsecured Wi-Fi

- Use only trusted Wi-Fi hotspots

 

Avoid these actions:

- Don't record security information in a way others can understand

- Don't share security information with others

- Don't leave devices without logging out

- Don't allow others to use your device while logged in

 

We reserve the right to suspend or terminate accounts for violation of terms or laws. If you discover unauthorized access or lost information, please contact us immediately at 02-013-9999 for account closure or correction.

 

  1. 7. Platform Usage Terms

 

Any actions through your account on our platform are considered complete and legally binding without requiring signatures. You are responsible for all actions taken. However, we may request additional documentation if deemed necessary.

 

  1. 8. Intellectual Property

 

Intellectual property rights related to the platform, such as names, logos, and images, are the sole property of AION (Thailand) or third parties. We permit platform and service use for personal purposes only. Reproduction, modification, or distribution of content for business purposes without prior written consent is prohibited.

 

Additionally, you grant us permission to use, reproduce, or modify content you provide for platform service purposes as specified in this agreement.

 

  1. 9. Limitations on Using Information as Guidance

 

The information on our platform, including financial information, is provided for general informational purposes only. You should seek advice from a professional before taking any action based on this information. While we strive to keep the information current, we cannot guarantee its accuracy or that it will always be up-to-date.

 

  1. 10. Service Liability Terms

 

Nothing in this agreement excludes or limits our liability for death or injury resulting from our negligence, fraud, intentional misrepresentation, or any case where Thai law prohibits liability exclusion or limitation.

 

We waive conditions, warranties, and other terms related to our platform and services, whether express or implied, as permitted by law. We are not liable for any direct or indirect loss or damage, such as:

- Platform or service usage or inability to use

- Information usage or reliance on platform information

 

For Business Users, we are not liable for:

- Loss of profits, sales, revenue, or business

- Business interruption

- Loss of anticipated savings

- Loss of business opportunities, goodwill, or reputation

- Consequential loss or damage

 

For Consumer Users, you agree to use our platform for personal and domestic use only. We are not liable for losses or damages from commercial or business use.

 

We are not liable for losses or damages due to:

- Legal proceedings

- Non-compliance with our service terms

- Circumstances beyond control (system failures, power outages, computer viruses)

 

We are not responsible for device damage from viruses or harmful attacks through our platform use, including linked websites. Such links should not be considered our endorsement.

 

This agreement does not establish joint liability among AION (Thailand) group companies.

 

  1. 11. Acceptable Use Policy and Content Guidelines

 

If you use features that allow you to upload content to the platform or communicate with other users, you must adhere to the following acceptable use guidelines:

 

Prohibited Uses: You must use our platform and services for lawful purposes only. Do not engage in the following activities:

 

- Violating any laws

- Using the platform in any illegal or fraudulent manner

- Engaging in actions or intending to cause harm to minors

- Sending unauthorized advertisements or spam

- Uploading or distributing viruses or harmful software

 

You must not copy or reproduce our platform for commercial or unauthorized purposes, nor attempt to interfere with any part of our platform, network systems, or software.

 

Content Standards:

 

These content standards apply to all content you submit or publish on our platform ("Your Content"), which must:

 

- Be factually accurate

- Comply with applicable laws in Thailand and the country where the content is published

 

Prohibited Content:

 

You are prohibited from submitting or publishing content that:

- Defames any person

- Contains obscene, pornographic, or inappropriate material

- Promotes illegal activities, discrimination, or violence

- Infringes on others' copyrights, trademarks, or intellectual property rights

- Is misleading, deceptive, or does not comply with legal obligations

- Threatens, invades privacy, or intends to harass others

- Impersonates others or misrepresents your identity

- Supports illegal activities, such as copyright infringement or misuse of technology

 

  1. 12. Suspension or Termination of Service

 

If we determine that you have violated the acceptable use terms or content standards, we reserve the right to take immediate action without prior notice.

 

Violating the acceptable use terms will be considered a breach of the service agreement, which may result in:

 

- Revoking access to our platform and services, either temporarily or permanently

- Immediate deletion of posts or content you have uploaded to the platform

- Issuing a warning of your misconduct

- Taking legal action to claim damages resulting from the violation

- Additional legal measures as appropriate

- Disclosing relevant information to law enforcement as necessary

 

If you wish to cancel the service, you can do so by selecting the “Delete Account” option on our platform. Upon receiving your request, we will verify the information, and if found valid, we will delete your account within 10 days of receiving the request.

 

  1. 13. Updates to Acceptable Use and Content Policy

 

We reserve the right to update or amend these terms at any time and will post updates on this webpage. Therefore, we recommend that you review this page regularly to stay informed of any changes, as these changes will be legally binding. Additionally, some specific provisions in the content standards may be replaced by terms or notices posted on other pages of our platform.

 

  1. 14. Virus Protection and Defects

 

You are responsible for properly configuring your computer system, programs, and devices used to access our platform, including installing antivirus software for your own protection. You must not engage in any actions that harm our platform or services, such as releasing viruses, Trojans, worms, or logic bombs, and you must not attempt unauthorized access to our systems, servers, computers, or databases. Should you engage in such actions, we will take the necessary legal action and immediately suspend our services to you.

 

If you detect any defects, viruses, or irregularities in our services, please promptly notify us with relevant details so that we can investigate and update you on the outcome via our contact methods, as outlined in Section 21.

 

  1. 15. Linking to the Platform and Connecting with External Resources

 

You must obtain our permission if you wish to create links to our platform on other websites. Our platform may include links to third-party websites or resources solely for informational purposes and should not be interpreted as endorsements or approvals of their content. We do not control or assume responsibility for the content or activities on those websites. You assume the risk associated with accessing third-party websites and resources.

 

  1. 16. Confidentiality Requirements

 

You are responsible for keeping all information related to our platform, services, products, operations, and business plans confidential, including any information you receive from us directly or indirectly. If you wish to use this confidential information, you must obtain our written approval.

 

Exceptions to confidentiality include:

- Information already publicly available

- Information you possessed before receiving it from us

- Information obtained from other sources without violating specified terms

 

  1. 17. Personal Data Management and Protection

 

You confirm that you have read and accepted the terms in our Privacy Policy, which outlines how we manage personal information we collect from you or that you provide to us. You can review more details in our Privacy Policy. You confirm that the information you provide to us is accurate, complete, and updated as necessary.

 

If you provide us with another person’s personal data, you must confirm that you have obtained the consent of the data owner in compliance with relevant laws, including permission for us to collect, use, disclose, and transfer the data internationally. We will act in accordance with our Privacy Policy and related service terms.

 

In accordance with our policy, you agree that we may record information related to your use of our services, such as conversation logs, which may serve as legal evidence. However, we are not obligated to retain such data unless legally required.

 

You also agree that we may send anonymized data to external parties, such as Google or business partners, for data analysis purposes. You can find more details in **How Google Uses Information** and **Google’s Privacy Policy**.

 

We may incorporate content from external sources, such as videos from YouTube, and use partner tools like Google Analytics for data analysis. These third parties are responsible for their own cookie use and tracking technologies set on our platform. If you do not wish to allow cookie usage or data-tracking features, you can disable them in accordance with the privacy policies of these third parties.

 

  1. 18. Assignment of Rights and Claims

 

You may not transfer or assign this service agreement, or any rights and duties related to this agreement, without our written consent. We reserve the right to transfer this service agreement or any associated rights and duties to others at our discretion. In such cases, you agree to cooperate, including completing any necessary documentation upon our request.

 

  1. 19. Governing Law and Interpretation

 

This service agreement is available in both Thai and English. In the event of any discrepancies between the two versions, the English version shall prevail. This agreement will be governed by the laws of the Kingdom of Thailand, and any disputes arising from this agreement will be considered and resolved by the competent Thai courts.

 

  1. 20. Notifications and Communication

 

You agree to designate only one phone number and email for communication with us. If any changes are made to your contact information, you must promptly inform us to ensure smooth communication. Additionally, any documents sent by us to the contact information you provided will be considered as received by you.
